New Jersey’s Cannabis Regulatory Commission has issued guidance for employers on standards and procedures related to workplace impairment.
If an employee’s drug test results shows THC in their system, an employer cannot use this result to fire them or write them up – unless that worker is prohibited by federal contracts from using cannabis.
However, if that positive drug test is supported with evidence-based documentation of physical signs or other impairment during work hours, the employer may take “adverse action,” including termination.
